NOTICE OF FINDING OF NO SIGNIFICANT IMPACT
AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Hudson County Division of Housing and Community Development.

REQUEST FOR RELEASE OF FUNDS

On or after March 25, 2026, the Hudson County Division of Housing and Community Development will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as 317 Broadway for the purpose of constructing a five-story building with eight units of affordable housing in Bayonne. $1,645,000 in HOME funding will be provided to the developer, 317 Broadway Bayonne, LLC, for the specific project site located at 317 Broadway, Bayonne, New Jersey.

FINDING OF NO SIGNIFICANT IMPACT

The Hudson County Division of Housing and Community Development has determined that the project will have no significant impact on the human environment. Therefore, an Environment Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Hudson County Division of Housing and Community Development at 830 Bergen Avenue, 5A, Jersey City, New Jersey, 07306, and may be examined or copied weekdays 9am to 5pm. It is also available online at https://www.hcnj.us/health-and-human-services/housing-and-community-development. Hard copies of the ERR may be requested by e-mail to THill@hcnj.us.

PUBLIC COMMENTS

Any individual, group or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Hudson County Division of Housing and Community Development at 830 Bergen Avenue, 5A, Jersey City, New Jersey, 07306. Comments also may be submitted by e-mail to eross@hcnj.us. All comments received within 15 days of publication of this notice will be considered by the Hudson County Division of Housing and Community Development prior to authorizing submission of release for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The Hudson County Division of Housing and Community Development certifies to HUD that David B. Drumeler in his capacity as Deputy County Administrator, or his representative, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Hudson County Division of Housing and Community Development to use Program Funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the Hudson County Division of Housing and Community Development’s certification for a period of 15 days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Hudson County, David B. Drumeler, or his representative; (b) the Hudson County Division of Housing and Community Development has omitted a step or failed to make the decision or finding required by HUD regulations by 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD Newark Area Office at cpd_generalcorr-nk@hud.gov. Potential objectors shall contact HUD to verify the actual last day of the objection period.
